1. Agreement to Terms

By accessing or using Mr. A's Writing Tools ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

If you are using the Service on behalf of a school or district, you represent that you have authority to accept these terms on behalf of that organization.

2. Description of Service

Mr. A's Writing Tools is an AI-powered writing coach designed for students in grades 2 through 8. The Service provides:

• Standards-aligned writing assignments with step-by-step guidance
• AI-generated feedback on student writing (provided via our AI sub-processor — see sub-processor list)
• Progress tracking and proficiency reports for students, teachers, and parents
• Teacher tools for class management, assignment distribution, and grading
• Parent portal for read-only access to their child's progress

The Service is provided for educational use subject to these Terms.

3. User Accounts

Account Types

• Teacher accounts — Created by authorized educators via Google Sign-In. Teachers manage classes, assign work, and view student progress.
• Student accounts — Created when students join a class via an invite code. Students use Google Sign-In for authentication.
• Parent accounts — Created when parents link to their child using a parent invite code. Read-only access to their child's progress.

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account
• Teachers are responsible for ensuring their students use the Service appropriately
• You must provide accurate information and keep it up to date
• You must not share account credentials or access another user's account

4. Acceptable Use

You agree NOT to:

• Submit content that is obscene, threatening, harassing, or illegal
• Attempt to bypass or manipulate the AI feedback system
• Use automated scripts or bots to interact with the Service
• Copy, distribute, or reverse-engineer any part of the Service
• Use the Service for any commercial purpose unrelated to education
• Attempt to access data belonging to other users, classes, or schools
• Interfere with or disrupt the Service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms.

5. Student Writing and Content

Ownership

Students retain ownership of their original writing. By using the Service, students (and their schools acting on their behalf) grant us a limited license to:

• Process their writing through our AI feedback system
• Store their writing and feedback for progress tracking
• Display their writing to authorized users (their teachers, parents)

We do not use student writing for marketing, advertising, or any purpose unrelated to providing the educational service.

AI-Generated Feedback

Feedback provided by the AI is for educational guidance only. It reflects automated analysis and may not always be perfectly accurate. Teachers should exercise professional judgment when interpreting AI feedback alongside their own assessment of student work.

Teacher-Created Assignments

Teachers may author custom assignments in our workspaces, including prompts, passages, vocabulary lists, sentence frames, AI coaching rules, and other instructional content. By creating an assignment in the Service, you grant us a perpetual, royalty-free, non-exclusive, worldwide license to use, reproduce, modify, adapt, and incorporate that content into the Service, including:

• Improving our shared assignment library, content recommendations, and AI coaching models
• Making your assignment available to other educators in anonymized or aggregated form, with attribution removed
• Using anonymized examples for product demos, marketing materials, and research about classroom outcomes

You represent that you have the right to grant this license — i.e., that the content is your own original work, properly attributed public-domain or open-licensed material, or content you otherwise have permission to use and share. You retain ownership of the underlying content and may continue to use it elsewhere. If you delete an assignment from the Service, we will remove it from active use within a reasonable period; however, anonymized data and aggregated improvements derived from your content may persist in our models.

6. Teacher Responsibilities

Teachers who create classes and invite students agree to:

• Use the Service in accordance with their school's policies and applicable law
• Ensure that student use of the Service is supervised or authorized by the school
• Not share class invite codes outside of their intended student group
• Report any misuse or security concerns promptly
• Obtain any necessary school approvals before using the Service with students

7. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key commitments:

• We comply with FERPA and COPPA
• We never sell student data
• Student writing is processed by our AI sub-processor for feedback only; our agreement with the sub-processor prohibits use of submitted content to train AI models
• Schools may request deletion of all associated data at any time

8. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Unexpected technical issues or outages
• Third-party service disruptions (our AI sub-processor, identity provider, hosting provider)

We will make reasonable efforts to notify users of planned downtime in advance.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will meet all your requirements
• AI feedback will be error-free or perfectly aligned with every teacher's expectations
• The Service will be uninterrupted, timely, or secure

The AI feedback feature is a supplementary educational tool, not a replacement for professional teacher assessment.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the greater of (a) the amount you paid to use the Service in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify registered teachers of material changes at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

12. Subscriptions, Billing, and Refunds

Some features of the Service require a paid subscription. Paid plans, their prices, and billing intervals (monthly or annual) are shown at checkout before you confirm. Subscriptions are processed by our payment sub-processor, Stripe (see sub-processor list).

Free trial

Paid plans begin with a 14-day free trial. We do not charge your payment method during the trial. You may cancel at any time before the trial ends and you will not be billed — this applies to both monthly and annual plans. If you do not cancel before the trial ends, your subscription begins and your payment method is charged the price shown at checkout.

Recurring billing

After the trial, subscriptions renew automatically at the end of each billing period (each month for monthly plans, each year for annual plans) at the then-current price for your plan, until you cancel. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis.

Cancellation

You may cancel at any time from Manage Billing in your account, which opens the Stripe customer portal. Cancellation stops all future renewals. If you cancel after a charge, your paid access continues through the end of the period you already paid for; it is not cut off immediately.

Price changes and failed payments

We may change subscription prices. Any change applies to your next renewal, not the period you are currently in, and we will give notice before it takes effect. If a renewal payment fails, we may retry the charge and may pause paid access until payment succeeds; your data is retained during this period.

13. Termination

Either party may terminate this agreement at any time:

• Users may stop using the Service and request account deletion
• Schools may request removal of all associated data
• We may suspend or terminate accounts that violate these terms, with notice except in cases of severe misuse

Upon termination, we will retain data only as required by applicable law or as described in our Privacy Policy.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
